Landlord Rights in Alabama - The 2007 Landlord Tenant Act

Prior to 2007, Alabama had amongst the most pro-landlord residential landlord-tenant laws in the country. While Alabama still remains a great place to be in the rental property business, The 2007 Alabama Residential Landlord and Tenant Act (The Act) and subsequent amendments, has placed new burdens and responsibilities on Alabama landlords.  The following list presents highlights of The Act, particularly as pertinent to Alabama landlords, and should not be taken as comprehensive.

Penalties against Landlords for Non-Compliance with The Act:

As originally enacted in 2007, The Act provided for a penalty of one month’s rent and possible payment of the tenant’s attorney’s fees by the landlord if a case involving a written lease that provided for said fees and costs ended up in court; however, in 2011 The Act was amended to only provide for such penalties if the landlord seeks to enforce written provisions for its attorney’s fees and costs.
